Medical Malpractice

Medical Malpractice

When a doctor, nurse or hospital fails to meet the standard of care, the harm can change a family’s life. Gardiner Koch Weisberg & Wrona has represented injured patients and their families since 1992, and we understand both the law and the medicine behind these cases.

What medical malpractice can look like

Malpractice can happen at any point in your care, including:

  • Mistakes during surgery
  • A missed, late or wrong diagnosis
  • Medication errors
  • Failing to refer you to the right specialist
  • Failing to monitor a patient
  • A hospital or care facility not following its own safety precautions, such as fall precautions

Birth injuries

When parents trust a hospital or doctor with the care of their newborn, that trust must not be broken. We represent families of babies hurt or lost because of medical error, including brachial plexus injuries, cerebral palsy, brain injury, meconium aspiration syndrome, shoulder dystocia, hearing loss and stillbirth.

Results for our clients

  • $5.42 million jury verdict for the family of a 55-year-old cancer patient who died after an adverse reaction to a chemotherapy drug.
  • $1.5 million settlement in what was, at the time, the largest stillbirth case in Illinois history. The case involved a failure to recognize signs of fetal distress.
  • $1 million settlement against a doctor who failed to diagnose and treat an aneurysm, which ruptured and caused a brain injury.
  • $700,000 verdict against a Chicago hospital for a patient with severe osteoporosis whose fall precautions were not followed.

Past results do not guarantee a similar outcome in any future case.

What to do if you think something went wrong

Write down what happened while you remember it: dates, names, and what you were told. Keep copies of bills and records. Illinois sets strict deadlines for medical malpractice claims, so talk with a lawyer soon. We will tell you plainly whether we think you have a case.
