We file actions for accounting, breach of fiduciary duty and fraud against executors and trustees, “caretakers,” and “friends” who have taken advantage of the elderly. We challenge fraudulent wills and powers of attorneys obtained by manipulative “friends” or family members. We also assist clients with the special legal problems of the elderly and permanently disabled, including guardianship proceedings and health care decisions.

Our Experience in Probate Litigation has Included:

- Representation of a trustee against an executor who refused to transfer funds to the trust

- Dissipation of Assets by an executor

- Termination of a trust prior to the planned distribution age

- Challenge to misuse of a power of attorney by stepson who transferred funds of his stepfather suffering from Lou Gehrig’s disease

- Challenge to distribution of funds from a convenience account after the family was told that the joint account holder had only days to live

- Cases involving wills prepared in foreign countries

- Cases involving claims where the decedent had no will
